garda card in the UK

garda card in the UK

can someone with a BNO passport, & recently issued garda card who is like 20 ( i think it has like some sort of 2 year thing / stamp 4, on it or something, as a dependent), come and stay in the UK or visit with his like mother while she works?.

is that allowed?.
he is already here-flown in from dublin - no checks out and in.
she cannot find work in ireland so came here again.
she is a british passport holder.

At any point did the mother work in Ireland?

very little with a few payslips.
he is already in the UK, but she is concerned he would be stopped by police and maybe sent back to ireland and stuff.

she is not working in the UK at the moment, but claiming benefits for herself.

He wouldn't be sent back to Ireland, maybe back to Hong Kong though, if he is present in the UK without valid leave if he requires it.. and I think he does, being that it appears, from what you have said, that the mother did not pursue economic activity in Ireland for at least 6 months prior to her return to the UK.

your right, she never made 6 months i believe.

he is leaving the UK in oct when he reaches 21 to apply for british citizenship there (HKG).

He doesn't have to be 21 to register as a British citizen. He must:
UKBA wrote: * be ordinarily resident in Hong Kong on the date of your application; and
* have been ordinarily resident in Hong Kong on 3 February 1997.
and, on 3 February 1997, must have been:
UKBA wrote: * a British dependent territories citizen by virtue only because of a connection with Hong Kong; or
* a British national (overseas); or
* a British overseas citizen; or
* a British subject; or
* a British protected person; and
* you must not have held any other non-British nationality.
Is your 20 year old friend ethnically Chinese?

well he does have a pakistani passport and ID.
but born in HK and has also a BNO passport & HKID card.

Which means he is a Pakistani citizen and thus not eligible for registration as a British citizen under the British Nationality (Hong Kong) Act 1997.
