Hi,

I came to UK on 6th Aug 2006 on Work permit (Through an Indian Company on secondment). I got Tier 1 in 7th Aug 2008.
I also first got salaried on Nov 2006 before I was on Indian payroll and getting expenses etc here. (I don't have P60 for this period)

I wanted to check if I'll be eligible for ILR in Aug 2011 or not?

If you're not salaried and taxed in the UK then I suspect it wouldn't count so your five years would finish in Nov 2011, although someone more senior might disagree.

Either way it is beyond the policy change in July 2011 and we'll have to see what the government brings in

Under current rules, you may qualify for settlement after completing 5 years in the UK - i.e.- Aug. 2011.

As for P60, it is not clear (from your post) for which year(s) you do not have P60. So please clarify.

Thanks guys for useful information.

This is the summary

1. Landed on 6th Aug 2006 on work permit (now called Tier 2 intra company transfer)
2. Salaried in November 2006 (Got P60 from this month onwards for 2006-2007)
3. Work permit extension in Sep 2007
4. Tier 1 in Aug 2008 and expires on 7th Aug 2011.
Got all P60 after Nov 2006.


Are Tier 1 (ICT) and Work permit (sponsored by company) treated same way? The rule change in 2010 April will impact me?

In case of current rule remains, will I be able to apply for ILR in Aug 2011 next year?

I don't think P60 for the year 2006-2007 not showing income & tax for 3 months between Aug-Oct 2006 should be a problem. If you have other documents (payslips, bank statements) for the 3 month period to show that you were employed and earning it shouldn't be a problem.
