staying on visit visa

Hi,

Have a query on duration of stay here. Plan to bring my mum here (applying for a 2 yr visit) and hopes to stay here from September 2010 till January 2011.

After that I'd like her to return in April 2011 but I understand that one can't stay for more than 6 months in 12 months although on the website it is not an absolute rule.

Please advice if she intends to stay for 8 months in 12 months, would that be an issue? If so is there a way around?

It's you call, get caught and she may receive a ban. So for me yes it's an issue and there is no way round it.

I didnt mean overstay, I meant stay 4 months on the 1st visit and then return for another 4 months making 8 out of 12 months!

Personally, I wouldn't risk it.

This is your call but remembered you would risk her future applications as well.

2x 6 months visa?

In that case its probably best to apply for a 6 month visa then on return get another 6 months after about 4 months staying back home I think. Will they issue another 6 month visa in such short period? sorry too many qns but answers much appreciated and once again thanks for all ur help.

Has she had a visit visa before? If not there's no way they will grant a two year one anyway. They need to 'trust' you!

Yes wanderer she was here in 2004 for 5 months on a 6 month visit visa albeit 6 yrs now. cheers

You can only stay for the length of the visit visa. After that you're an overstayer.

In that case, she's good to apply for a two year multiple entry one! Doesn't matter that it was in 2004. What matters is that she did not overstay at the time.
Forget about the staying 8 months out of 12, by dividing it into 2 visits. Still comes to the same thing! (As in more than 6 months, in a 12 month period)
Keep within the stipulated guidelines to avoid 'denting' your mum's immigration record.
