Tier 2 COS Refusal

I applied for an extention of leave under the transitional arrangement having been a work permit holder for the past 4 years. My leave was due to expire on the 7th of July 2010 i filled the application and returned it as requesed to my employers for them to apply for a COS. They sent the form to UKBA without paying for the COS(an oversight). My application was refused on the basis that i did not have a valid COS all other conditions would have been met under the transitional arrangement, and have appealed to be heard at the end of october. Payment has been made and the COS is availabe but would expire on the 3rd of september 2010. Would i be able to make a fresh application when my leave has expired? or wait for the appeal by which time the current COS would have expired and a new one would have to be applied for. In a similar case it seems that the application was returned and not refused correct me if i am wrong.Please help i am so confused

Go and speak to an immigration consultant and seek legal representation at the appeal. Anyway, what was the timeframe between applying, biometrics and the subsequent refusal? Goodluck mate.

Thanks for your reply, it was 5 weeks in total biometrics was within 2 weeks.

Thanks for the info and goodluck. Listen to as many opinions as possible but give more weight to what the consultants tell you.

how could you(applicant) send an application before having a COS and how can your employer give you a COS without getting themselves officially registered!!!

They are fully registered its a large NHS Trust. They asked me to take the completed application form to them so that they can apply for a COS. This is done online but payment must be sent using a payment slip if paying by cheque. They sent the form without sending the payment.
