WP + HSMP + Tier 1 - missing P60 for 2nd year

Hello,

I got wp in Jul 05 for 60 months. my company liquidated in apr 06 (i was unaware of that) and thus i was technically unemployed though i was get paid till 22nd July 06 (that was for the wage period May 06). I applied for HSMP and got it in Oct 06 but could not get stamp on my passport till Jan 07. I started working for another company since Feb 07.

I have P60s for 05-06, 07-08, 08-09 and 09-10 but missing one for 06-07.

I got my HSMP extension (as Tier 1) in Jan 09.

Should i apply for ILR now and explain full circumtances or should i wait till i finish 5 years on Tier 1 and then apply?

I still could not get complete answer.

I have all the p60s apart of one for 06-07. I was on workpermit till Jan -07 and then on HSMP. I have pay slips till May 06 but then i was unemployed (as my company was liquidated in apr 06) till Feb 07.

Do i have to be emplyed and paid(technically i was employed, as i never received P45 from my company but never been paid after Jul 06) and paid during my work permit?

Please answer.

Sorry about this but i am confused...

You say your last date on WP company was May 06 and you applied for HSMP in Oct 06? To what i know once you have been made redundant on WP, you have 28 days to leave or apply for new visa.. and i dont see this happening here.....as it seams you were in the country for 4 months after your company got burst...and to add you got the stamping done in Feb 07...

If you applied for HSMP from home country, you will have to wait for 5 years to complete as i seams you were out of country for 90days +.

I do not want to confuse you but this is what i can understand... I would recommend is to get your SAR request from HO and make sure all clear.

I have seen some cases where people with one P60 missing got the ILR.. as long as you have P60 for last three years whould be fine....

I actually applied for the HSMP in April 06 which as rejected as my payslips were not on headed paper. I appealed against the decision and was waiting for Home office's reply. Just to add to your knowledge, I got paid for May 06 period in July 06 and still I was completely unaware of the liquidation of the company as I was working at the client site all the time.

well after 3 months of appeal (in Oct 06) I got all my previous payslips on company headed paper but still did not received any reply from Home office and so I requested to withdraw the appal and made fresh application with payslips on headed letters. I got the HSMP approval in 10 days after that.

I was still anaware of the company going burst as previously many times i received my wages after 3 months. I never got P45 from my company. I ultimately decided to find another job as I was not getting my company director on the telephone.

I am jotting the timeline here again.

July 05 - recd work permit for 60 months
Apr 06 - Applied HSMP for the first time
Jun 06 - HSMP rejected as my pay slips were not on headed paper. I appealed against the decision on very second day and supplied all bank statements.
Oct 06 - after 3 months of wait I withdraw my appeal as i got my payslips on headed paper on the same day i made fresh application.
oct 06 - I recd HSMP approval. I still wanted to work with my existing company and till october the company director was promising me by saying that i will be sent to another client site soon. I had no intention of leaving that job.
Jan 07 - I recd visa stamp on passport
Feb 07 - I started working for another company as i was unable to reach to my previous company director anymore. I never received P45 from that company.

1 - Get your SAR file to see what they have got for you.

2 - Apply by post and do not send any P60. If you read posts of those who applied by post, you will find that not many people send their P60s. Send last year payslips and bank statements.
