ILR or FLR

I am a british citizen my wifes visa is due to expire on the 17th of august, she has failed her life in uk test and is retaking it on the 21st. Should i wait to see if she passes then send the ILR(M) form or get an extention to her visa and send the application on time? i have read ppl send it late and has no bearing on the outcome.

I wouldn't risk it and extend the flr(m) as you don't know if she'll pass this time either.

will applying late by a week cause any problems i could say i didnt realise the visa had expired

That won't save you. Otherwise people can just say "I didn't realize I became an over stayer"

thanks for the advice ill do that, is the extention for 2 yrs and can apply for settlement visa set(m) during or does it have to be the last mnth before u can do so.

You can apply for ILR as soon as she passes the test after extending.
