Restrictions for entry for children

Post by chakku71 » Wed Aug 11, 2010 8:33 am

My wife and I became UK citizens through naturalisation in 2010. We were Indian citizens- HSMP (JR)- we have the OCI's now. Our children are Indian citizens as they were born before our ILR-they have ILR since 2008. We have not changed their citizenship and not planning to do so in the near future.

If we were to relocate to India in the next few years and live there for a few good years.
1. Will my children loose the ILR- I am assuming it is a 'yes' if the absence is more than 2 yrs.
2. If we (parents) change our mind and come back and settle in the UK and if the children are still minor (and we wanted to continue their education here), having lost the ILR status, as rules stand today would they be able to accompany 'any one parent' as dependents?
3 As things stand today, how quickly can then get UK citizenship after arriving in the UK as dependents (it is understood that they are still minors then).

Thank You
BB

Are you seriously telling us you have become British citizens yourselves but denying this for your children?

1. Yes.
2. They will need to apply for EC as child(ren) of British citizen(s) to enter UK after expiry of ILR.
3. Will depend on the age of the children then. AIUI, children above 13 need to fulfil residential requirements to be eligible for citizenship.

Thank You Sushdmehta,
Just a clarification..
1. What is AIUI?
2. What is the difference in residential requirements for children below & above 13yrs?

As the children were born in the UK, they are entitled to register for British citizenship 1(3) while they are under 18.

AIUI - As I understand it.

Now that you have shared that the children were born in the UK, follow Vinny's response regarding children's entitlement to British citizenship.

Thanks Vinny- as usual, the answers are spot on.
