Hi

I am seeking help for 2 of my friends who both are foreign nationals living in the UK. They are lesbian and have lived together for a few years now. They unfortunately let their visas expire before seeking help. The problem they have is that they can not go back to their countries because they would not be allowed to get married there + they would be forced to marry male partners and live unhappily ever after. They wish to get married in England and continue living here as a married couple. Do they need to get CoA? Can they get it in spite of their immigration status? Finally, can they claim asylum as if forced to go back to their country they would not be able to live their lives normally ever again.

Any help and thoughts on asylum, lesbians, human rights - are much appreciated.

We need to find solution for these 2 poor girls!!!

To be brutal, absolutely no chance, the UK is not a catch-all for disgruntled citizens of other counties to come here and settle.

Both their countries are anti-gay? Strange isn't it? Any why can they not live in one of their home countries and be discreet? Jesus Christ!

Do they need to get CoA? - No - they need to get a dose of reality....

It's not impressive that they have only raised this problem after their legal stay in the UK has expired.
A fundamental criterion in the decision over any asylum/HRA claim would be the law on same-gender liaisons in their native country.

Be aware that 97% of all gay asylum claims are refused as it is very difficult to prove you are gay

OP, why do they want to live in England? There are so many homophobes here. Try San Francisco :D (I'm from there and we love our gays).

Hey! London has an annual Gay Pride parade and is a very diverse city. As is Brighton, very gay friendly. Coming from that side of the world you will find Australasia has it's fair share of homophobes. Where men are men and the sheep are very afraid :lol:

Anyway very strange to suddenly remember that your country is completely homophobe shortly before your visa expires. Was there not a case recently where a foreign national about to be deported after a stay in prison then all of the sudden remembered he was gay? But I do understand that it's easy to meander happily throughout your stay and life, then all of a sudden your visa expiry creeps up.

Your friends should head home and research other options to gain a UK visa or any other "gay friendly" country, doesn't have to be the UK.
