spouse visa expired Urgent advice !!!!!!!!

my wife came on a spouse visa in aug 2008 but on her passport it says her visa was valid until july 2010. I assumed that u had to apply one month before date of entry. I am really worried i need some advice.

You would normally apply for ILR 28 days before 2 year anniversary of date of entry...but not if she entered the UK late..meaning the visa would have expired.
What date did the visa expire and has she passed the Life in the UK test (or completed an ESOL citizens course)?
I've added an edit to this...
I've just trawled through your previous posts and notice that you say the visa expires on the 17th August??
I also see that she failed the KOL test.
Has the visa expired or not?

the visa valid from 22/07/08 to 22/07/10 she arrived in the uk on the 17 of august 2008. i didnt check the passport till today. when i was filling in the flr form

As she hasn't passed the KOL test you will have to apply for FLR(M) and ask for the UKBA to use their discretion regarding the out of time application. Send it today special delivery with a covering letter...and keep the receipt.

If it isnt, then not only will you have lost something like £850, you could also be sent back home and asked to reapply. Maybe seeking advice from an OISC advisor is highly desirable in this case. Do it quickly as well

ILR granted for my wife and child, itsa a huge relief, had so much negative thoughts going through my head. it was quicker than i had expected but im grateful that the overstay didnt effect the ilr.
