Right but he applied for a fiance visa and is trying to sort out the wrong endorsement from what I gathered.laraj wrote:He isn't coming on a fiance visa. He's been granted settlement because they have lived together for over 4 years as a couple. They can just marry over here in the UK when he comes I have found out today.
As already mentioned in one of your other posts, decree nisi has not legally binding because it is conditional therefore may not be accepted as evidence of dissolution of marriage.kingkhan wrote:does any1 hav any experience geting COA without showing decree absolute of partner coz i have applied for it and we havent yet recived decree absolute but we hav got decree nisi
I undersatnd your point but my understanding is COA is to check if the marriage is genuine or not and its registrar office who ask for decree absolute when you go there to give notice.sushdmehta wrote:As already mentioned in one of your other posts, decree nisi has not legally binding because it is conditional therefore may not be accepted as evidence of dissolution of marriage.kingkhan wrote:does any1 hav any experience geting COA without showing decree absolute of partner coz i have applied for it and we havent yet recived decree absolute but we hav got decree nisi

Unless your partner is legally free to marry you (i.e. - earlier marriage is declared dissolved by law and without any conditions attached), you cannot claim that your marriage will be genuine 'coz AFAIK bigamy isn't allowed in this country.kingkhan wrote:I undersatnd your point but my understanding is COA is to check if the marriage is genuine or not and its registrar office who ask for decree absolute when you go there to give notice.sushdmehta wrote:As already mentioned in one of your other posts, decree nisi has not legally binding because it is conditional therefore may not be accepted as evidence of dissolution of marriage.kingkhan wrote:does any1 hav any experience geting COA without showing decree absolute of partner coz i have applied for it and we havent yet recived decree absolute but we hav got decree nisi
