Unfortunately communication to arrange for biometrics is no indication of success (or failure) of the application. If you search the forum you'll find many posts mentioning that the application has been rejected even after biometrics were given.

Have a look at the flow chart (left one) on the last page of this document. Do note that the flow chart doesn't state anywhere that only successful applicants will be called for biometrics, but only that ICFNs will be issued to successful applicants. IMHO ...

I had thought this government had ditched the whole notion of ID cards and biometrics. Have I missed something in the news.

Only National ID cards, subject to parliamentary approval and from a given date in future.
Is the biometric residence permit also being scrapped? wrote:No. The UK Border Agency (UKBA) will continue to issue biometric residence permits to non-EEA foreign nationals.
European law requires non-EEA foreign nationals to be provided with biometric residence permits.
They are separate from the programme to introduce the UK National Identity Card and the Identification Card for EEA nationals, and are issued under entirely different legislation.
The biometric data is not kept on the National Identity Register.

hi I applied for ILR in aug 26 2009, got the acknowledgement on 28 aug 2009. I received my ILR on 09 april 2010. ILR issue date was 27 feb 2009. I had to call my mp & he gave them the call to speed up the application. Can i apply for citizenship in aug 26 2010 or do i have to wait until 27 feb 2010 coz home office took almost 30 weeks. i applied under the 10 years long residency. any replies welcome.

for all those who are waiting, i will recommend to write a reminder letter and den ask your mp, & he would give them the call to speed up the application.

regards

raz

Going by the relatively recent trend, it appears some people register on this forum and within days of registering here, low and behold, receive back their passports. Must say registration on this forum esp. this thread tends to miraculously expedite their long pending ILR applications.

Hi,

I have been following this thread for a few months.

My application was submitted on 18/12/09 by an immigration advisor, who said it was a 'straight forward' case, which turned out it was not.

I am considering making a complaint and/or suing him for professional miscondut, as I have subsequantly discovered he did not follow the rules layed out in http://www.oisc.gov.uk/, and this indrectly resulted in my long and uncertain wait for a decision.

If you have used and would recommand an immigration advisor, please pm me, as I will probably need more advice in the near future when my circumstance changes. Thanks!

IF UKBA gets in touch regarding the failed payment and asks for it to be rectified rather than returning all paperwork submitted then it should be fine as it can be done straight away.

Otherwise if the application gets sent back and marked as invalid then unfortunately it means that she would have to make a brand new VALID application which obviously will not be in time so she would not be entitled to 3C leave.

Looking at current reports, more cases seem to be handled in the second way.
For this it is important to quote a case already raised on this forum. Also, if the invalid application comes back with a letter that clearly dictates, "You have 28 days to return your application", that clearly indicates an extension of leave, as those 28 days are for you to get your application in order and return it to them.
vinny wrote:Update -
Case law round-up wrote:More importantly, the Court of Appeal in JH (Zimbabwe) [2009] EWCA Civ 78 made a very important (but how so dry!) decision on use of prescribed forms and the extension of leave by s.3C of the 1971 Act. The tribunal’s highly restrictive interpretation in DA (Section 3C – meaning and effect) Ghana [2007] UKAIT 00043 is disavowed and the Court concludes that:

(i) the appellant had used a ‘prescribed’ form, even if she had no chance of getting what she asked for, and therefore had made a valid application which therefore extended her leave under s.3C while the application was pending, and

(ii) that it is possible to vary an application for leave once it is made, even if leave is already extended by s.3C, as long as a decision has not yet been reached by the Home Office.

This case makes life considerably simpler for immigration applicants who are badly advised or use the wrong form.
so regardless of the type of application, the high court ruling suggests something different to what you have suggested.

The primary cause for concern with 10 year applications with the HO seems to be the issue of "out of time" applications received. From the ruling above, it is safe to suggest that applicants are within s.3C on the grounds that they have submitted "AN" application, regardless of its outcome.

Excellent - I am looking forward to hearing from you soon, you waited so long and really deserve it now.

Cloudstar, did you speak to someone on the general helpline or did you call the actual unit at Liverpool? I will meet 6 months timeline on 10 th Septemeber. From your own experience , Cloudstar, are they providing a bit more information when you call them after 6 months?

Hie Powermatic, I called the general application progress line and for the last weeks kept getting the same STILL UNDER CONSIDERATION reply, until yesterday, I was actually shocked because I was expecting the same reply as before.

Thanks Zeddie I hope so too, I could hardly sleep last night and hope I get it today.

Here comes updated list - lucky Cloudstar received his ILR after 36 weeks wait, I hope it will be sooner for the rest of us.

I did not update the number of waiting weeks as this is very timeconsuming. To be honest I think that we should only state the number of waiting weeks in the Received column. In the waiting column every member will know the amount of time they are waiting, so we should use it just as indication of which month is currently under consideration. Hope you agree...

I know it is irrational to say this. I want to go on a hunger strike outside their office.
