How come i am over stay for more then 28 days - home office give me the final letter on 25th of May in which it stated that -

Statement of Reason:

"You Applied for Furthur Leave to Remain as a student in the UK on 28/02/09 which was rejected on 10/03/09.How ever you didnot make your next application for furthur leave to remain as a student until 30/03/09 which was again rejected on 20/04/09. Due to period of 20 days elapsing between these applications you are being classed as an over stayer"

I guess it means i am over stay for 20 days - i fulfill in that condition given below in section 7(b)

unless the applicant:

(i) Overstayed for 28 days or less and left the UK voluntarily, not at the expense (directly or indirectly) of the Secretary of State;


Do you guyz think i am on right track?

You became an overstayer on 10/03/09 if any one of the following is true:
1. You did not get a right of appeal.
2. You were given a right to appeal but you decided to not appeal the decision within the stipulated time.

sushdmehta wrote:Acceptance of out-of-time application by UKBA for consideration doesn't make your stay in the UK during that time any legal - because out-of-time applications do not attract Section 3C protection.

so why they didnt show in the letter on 25th of May IS151A that my period from 10/03/2009 to the date i get IS151A 25/05/2010 is over stay coz my application iz rejected

why they count me for 20 days :S
thats why i am bit confused ...

it's quite clear what sush has said.. all i can say is that file for the AR anyway.. it's free and u have been given an option for it.. you could say that u filed another application after it was rejected on 10/03/09 within the stipulated period of 28 days which is the time given for you to leave the UK. This is of course lame and would not work but i dont see any other way in which it could be done..
