Tier 1 Eligibility ??

hi All,

Looking for some help re my eligibility for the tier 1 visa. I am currently on tier 2 intra comp transfer and have been in the UK for the past 3 three years. I thought about switching to tier 1 category but here's the jist of my problem.

I dont know if i can claim enough points for my previous earnings because i receive £1900 every month but it's after the tax deduction because my company manages taxes and all. The latest tier 2 letter i got from my HR shows my salary as £ 38445 and i claimed 25 points for the prospective earnings. The problem is there is no way of showing the gross I earn as the salary slip generated by company only shows 1900 as the monthly allownace.

Is there a way out ? Can I use a letter from my employer showing my gross salary and as a second proof my bank statements with the disposable income ? Thoughts pls. :roll:

You can get a letter from your employer with your gross and net salaries and this net salary should match with the salary deposits in your bank statement.

Reading the policy guidance will greatly help you in preparing your tier 1 application and will also have info of all the documents accepted.

Do you receive any other salary from your employer?
Income tax and national insurance are unlikely to add over £15k.

Yes I do receive the offshore component as well which is now added to the allowance I get in the UK. It's nearly 38K or an additional ~500 to the UK allowance per month. I had contacted my employer to get the breakdown of gross and net but they are not willing to give it to me given the purpose itself is to leave the organisation :wink: . I was wondering if I could use the current Tier 2 letter from home office which confirms 25 points for salary or is there something else that could be tried.

I am gonna ring my HR once again for sure :P.

According to new rules of Tier1 after april 2010 for £38445 you should be getting 20 points (£35000-£39999 slab)

ya i know, but the problem is getting the proof from two different sources. I can show my bank statements which will have only the alownace of 1900 permonth + my offshore salary. As a second proof i should show a letter from my employer with the gross salary and the breakdown of every months salary which they are not willing to provide because there is something wrong with the way they deal with the taxes. Oh btw i work for tcs - it will give you some idea :wink:

As an offshore salary i guess only net component will be credited to your bank account & hence consider the gross income of that.

Be it offshore or inshore or any shore, only net salary is credited into the bank!

Your employer is required by law to provide an adequate payslip showing gross, deductions and net. They are either failing to do that or the are correctly showing that you are being paid less than it stated on your CoS.

Either way they are breaking the law.

Any idea about how to find UK NI Contributions from NI Number ? Can we use that as a source ?

If you have been here 3 years then TCS will almost certainly be deducting income tax and ni from your gross, and by law they should be giving you payslips with this information.

Threaten to take them to an employment tribunal if they do not provide the information

What if someone has, would your employer give it to you if you need it?

Are you looking for information to be included in the letter or interested in knowing whether employers issue such a letter or not? Request for such a letter may be a clear give away that you intend to change immigration category and, irrespective of whether other employers issue it or not, your employer may have reservations.

And, please don't make multiple posts on the same subject.
