CCL - 1 Year Ban - Left Country

CCL - 1 Year Ban - Left Country

Hi All,

I had my PSW on the basis of CCL from Sep-2008 to August - 2010. I Left UK and my well paid job in August 2010.

After reading many testimonials and stories of other CCL affected person, I understand that I will not be allowed in britain for atleast 1 year when I have left the country on my own. I have few queries if experts on this forum care to reply:

1. When I leave UK on my own, Do I need to inform UKBA prior to my departure?

2. Is this required that my Passport has the stamp or ref of UKBA that my existing Visa (PSW) stands cancelled? Or I am under a ban period.

3. Can I apply for a UK Visa exactly after 1 year (probably in Sep-2011)?

Has a 1 yr. ban been imposed on you? If yes, then you cannot apply for EC for exactly 1 yr. from date of issue of any such ban.

CCL qualification may still haunt you (any future EC applications).

Hi,

No, HO has not explicitly put any ban on me. Since receiving my PSW I neither applied to HO for any kind of visa extension/change nor travelled outside of UK to be caught at port of entry.

My Visa started from 2008 and finished in 2010. So I left UK 2 days prior to my PSW expiry. Now I am in my home country.

Since I have left UK, does this mean that my ban has automatically started?

If I am not subject to a ban then if I happen to apply after September 2011 for a UK Visa, can my 1 year time staying out of UK be considered same as serving a ban and provided that I fulfill all other visa requirement for the visa applied for, will be granted a UK Visa. Or

Do I need to inform HO that I have left UK and wish to serve 1 year ban period so I could become eligible for a UK visa?

What I am unable to understand is why you think you are subject to a 1 yr. ban (that you wish to serve) when you yourself state that no ban has been imposed on you?

Am I missing something here?

Aplogies for confusion.

I want to know if my staying away from UK for one year will be considered as serving a ban period whether or not I have been explicitly banned. Or

Do I need to inform Home Office or now UK embassy (as I am in my home country) about my situation and receive some kind of letter from them which would state that I am under ban now and will be eligible to apply for a UK visa after 1 year?

So as my staying away from UK for 1 year is not considered as a ban and now when I apply again after 1 or 2 years for any UK visa, can then HO refuse me on the basis of my CCL-PSW and ask me to serve a 1 year ban?

Yes, if your qualification from CCL is not considered by UKBA to be a "genuine" one and if you apply in an immigration category where you use CCL qualification to claim points to qualify.
