Naturalisation Dates

Pease can someone kindly look into to the following dates and advise me when to apply for Naturalisation and if I meet the residential qualifying period.

FIRST ENTRY TO THE UK
24th DECEMBER 2006

FIRST TRIP ABOARD
16th APRIL 2008 - 5th JULY 2008
(80 days away)

SECOND TRIP ABOARD
20th JUNE 2009 - 12th NOVEMBER 2009
(145 days away)

When were you granted ILR? And on what basis (Tier 1 / Tier 2 / WP /spouse of British citizen / some other category)?

Thanks for your quick response I got my ILR on 10 March 2009 as spouse of British citizen

The 145 days absence in 2009 is a problem - as one cannot spend more than 90 days outside the UK in the 12 months of the 3 years (residential requirement) period.

I guess you will be able to apply for naturalisation only after 12-Nov-10 (assuming no more absences or not exceeding 45 days).

Were you present in UK on 15-Aug-07?
Did you spend less than 270 days outside the UK between 15-Aug-07 and 14-Aug-10?
Did you spend less than 90 days outside the UK between 15-Aug-09 and 14-Aug-10?
Were you free from immigration control between 15-Aug-09 and 14-Aug-10?

If the answers to all the questions above is *yes*, then you fulfil the residential requirements for naturalisation on 14-Aug-10.

In fact that does not apply, given they are the spouse of a British Citizen. They simply need to have got their ILR, but not for any particular period of time.

salah100, based upon what you have posted, you can apply for Naturalisation any time from 14.08.10 to 15.04.11.

If you don't (apply between 15-Aug-10 and 15-04-11), then you'll be able to apply only after 5-Jul-11 because one of the requirement (amongst others) is that you should

salah100, I think you have already had your answer. One of the tests is that the applicant, married to (or in Civil Partnership with) a British Citizen, must have been in the UK exactly 3 years before UKBA receive the Naturalisation application.

So, for example, could the application be made on 30.04.11? Well no, because the applicant was outside the UK on 30.04.08.

John and the rest this topic has just cought my eyes seems interesting and would kindly like to know/learn more about those dates.

I was trying to work out on the dates you have mentioned ie being away from the UK etc and i seem not to understand or rather get round it. Got confused to be honest.

Like for example my case, i got my 2 years spouse visa on 09.10.08 i was away on the 28/01/09 and back 20.02.09(21days) and then 15.10.08 back on UK grounds 1.11.08 (15days) and then i was away this year from 14.04.10 back on 17.05.10(32days), so when am i due to apply for my british citizenship next year?when do i qualify for the 3years?

Kindly advise as think very important to work out on the dates that i might be out in future.

mteja, did you spend any time in the UK in the period from 23.05.07 (3 years before today) and the date of 09.10.08 that you mention?

If so, details please.

Given you mention a 2-year spouse visa suggests that visa was issued in the UK, so what did you have before that?

John am not yet due for british citizenship until Sept 2011. And yes i got my first stamp for spouse visa on 09.10.08.

As per your question 23.05.07 i was in UK but as an overstayer so i spose that doesnt count in citizenship process
