B1 in lieu of H1B

B1 in lieu of H1B

A friend has a small company that is contracted to provide services to a UK branch of a US company. The client would like him to go to the US for a couple months.

The work would more than appropriate for a B1. Does the 'B1 in lieu if H1B' still exist? Would it be appropriate? Does anyone have experience of getting one?

Probably a bit more than just meeting with the client and knowledge transfer, but all payments will be in the UK.

He should be ok, if two months is considered "short" enough by the POE officer. However, there's no way to tell in advance.

Personally, I wouldn't risk it.
