PSW FROM HOMECOUNTRY {INDIA}

Post by julieuk » Thu Sep 23, 2010 7:06 am

HI EVERYBODY,

I'VE COMPLETED MY Msc IN MARCH 2010 AND I APPLIED FOR PSW IN MAY 27 2010 WITHIN THE UK. MY STUDENT VISA EXPIRED ON MAY 30 AND DUE TO THE FUNDS PROBLEM MY APPLICATION WAS REFUSED AND IT CAME BACK TO ME ON 27TH JUNE.

I LEFT THE UK ON JULY 7TH AND NOW I'M REAPPLYING FROM INDIA AGAIN IN OCTOBER WITH AVAILABLE FUNDS.

HAVE I STAYED OVERTIME IN THE UK?

What does your refusal letter say? It usually gives a period of time in which you need to leave the country. 28 days? In which case, you're fine, but wait for expert advice.

Also, please don't SHOUT (as per T&Cs of this forum) :)

You have overstayed but since it is less than 28 days this should not affect future EC application(s) (320(7B)).

Answer questions in the form regarding immigration history honestly.

thank you sir,

are the days counted from the day on which I received the refusal notice along with my passport? or from the date on which my visa expired?

Since your leave was deemed to be continuing under Section 3C till the date you were given the right to submit an appeal, the overstay period should be counted from that day onwards (last date to submit an appeal against the refusal to the date that you left UK).
