Tier 1 (General) dependant query

friends,

I am creating this thread to ask doubts to which I didn't find answer after going through this forum for couple of days now.

I am staying and working in Mumbai for 5 years, and in chronological order the events are as follows

1. got married in June 2010
2. Got Marriage registered in August 2010, with date of marriage as it was originally, i.e. June 2010
3. Applied for Tier 1 (Genreal) visa and got it stamped in September 2010, shown in the form that I am married but my wife will not be travelling with me or joining me later.
4. Getting the lease agreement redone in a few days, to include my wife's name, for address proof, made one account as joint for both of us.
5. Applying for dependant visa for my wife after step 4. within this month.

NOTE: I do not have a job yet in U.K. and have never travelled to U.K., none of us actually. I am not looking for a job in U.K. till December 2010, but want to get the dependant'e visa for my wife as early as possible. Do you think this is possible?

You do not have had travelled to UK or have a job in UK to apply for a dependant visa.

if you are inside UK or out side UK you can apply for dependent visa in both cases.it is not necessary to have a job in UK for dependent visa please read the following,

I shall try my best to make it simple for you how to apply for dependent visa in your case.

documents you require

Mandatory requirements:
1. Application form, duly filled and signed.
2. Application fee.
3. Photograph(s).
4. Copy of personal details pages of main Tier 1 migrant passport.
5. Copy of current leave to enter / remain (visa) of main Tier 1 migrant.
6. Proof of relationship (marriage certificate, birth certificate).
7. Evidence of maintenance funds as specified in the policy guidance.
8. Cover letter from the main applicant (you).
9.Cover letter from the applicant (dependent)

Bank statement you require

you should have 800 for yourself and 1600 for your wife 800+1600=2400 pounds or equivalent for consecutive three months in your or her bank account

If the main applicant has got VISA already and wife is applying for dependent separately than your wife need to maintain £1600 for 3 months but again submitting the main applicant bank statements is not necessary. Please confirm it with Point 40 of the Policy Guidence.

yes you are correct

for new and fresh applicant of tier 1, if applying together with
dependent,maintenance requirement shall be

2400+1600 for each dependent=4400 pounds

for successful main applicant who have got tier1 visa without dependent,than in this case point 40 of policy guidance apply

so I think in this case he should have 800+1600=2400 pounds for three months

case 1-- If you are going to show your bank statement than definitely the funds should be £1600+£800=2400.

but

case 2--if your wife is showing her own bank statements only than I don't understand what is the need of showing additional 800 for the main applicant who has already got visa.

I didn't find it much clear in the policy guidance.

wats your take??

this is the criteria set by UKBA for a dependent of tier1 visa if entering or wish to enter in UK even if someone tier1 visa have been approved.to live and work in the UK, UKBA think you should have enough money in your account to live and accommodate yourself until and unless you get the job, that's the reason I think ukba has made necessary for both I mean main applicant and dependent to have sufficient funds before entering in UK or after arrival in UK..... that's what I have understand for maintenance of funds philosophy by UKBA
so you should have 800+1600=2400 pounds

For proof of marriage done in June 2010, I am submitting the following

1. Marriage Certificate issued in August 2010 with marriage date as of June 2010 (actual)
2. Lease agreement with both our names on it, done in October 2010.
3. Bank statements for 3 months for funds of our joint account, having the same address as in step 2.

Does this suffice?
