Tier 1 dependants may not be able to qualify 4 ILR in future

Post by mtuckersa » Sat Oct 09, 2010 4:06 am

How is this going to work? So if you already in under HSMP you can still get ILR but any new applicants NO?? Anyone who can shed a bit more light on this? Also what effectively will happen after you have done 5 years on a Tier 1 visa, can you go straight on ILR(see 2nd paragraph below) or Probationary citizenship(1st paragraph below)? One thing that gets me is that its never clear who and how this applies to people already in the country, are they referring to new applicants or everyone. The 2nd paragraph seems to imply that its only applicants after a certain date. The 1st paragraph seems to imply its just everyone regardless of when they entered the UK. All too confusing....

' It should also be noted that from July 2011 it is likely that you will no longer be able to apply for indefinite leave to remain. You will need to come under the more complicated "path to citizenship" scheme.'

'The government will continue to meet its obligations to migrants who entered the United Kingdom on the Highly Skilled Migrant Programme (HSMP) and had a legitimate expectation that they would be able to apply for and be granted indefinite leave to remain, in accordance with the Immigration Rules that were in place when they applied to the HSMP.'

This article itself does not provide any reference and is too vague. Starting off with a sensational headline it goes tangent to focus only on dependant children over 18 years of age.

This seems a stale Blog post.

We all are waiting for the MAC recommendations to be released, any other news flash does not seem reliable, really.

Don't confuse marketing / sales strategy of a commercial organisation with govt. policy.
