Post by fgag » Fri Oct 08, 2010 6:21 pm

I am a british citizen and want to get married to my fiance which has been living in the uk for 8years(illegaly) we went to speak to a silicitor and the solicitor said if you want to get married first of all you would need some type of documents (bill under our name and rent contract). we said how long would it take for the ho to send us a certificate and he said 7 MONTHS we found it quite awkward because it normally takes 1 month or probably abit more than that and the reason for it taking so long is because he is living in the uk illegaly is that true and normally how long does it take the ho to send a certificate?? please help

The Home Office are due to withdraw the Certificate of Approval, although no date has been confirmed. Your solicitor should have advised you that if you apply for a COA for permission to marry this may well alert the Home Office to your fiance's illegal residence and he could be removed before the marriage takes place.
Even if you are able to marry (with or without a COA), he will still need to return to his home country to apply for a spouse visa to settle legally in the UK.
What is his nationality and are you both over 21?

The quickest route may well be for you to return to Turkey with him and marry there and then apply for a spouse visa for him to re-enter the UK.
However, this depends on whether he has used a false name or documents during his illegal stay here which could mean a refusal.
Bear in mind that marriage in the UK doesn't legalise his stay here.
These are all points a reputable legal advisor should be explaining to you.
