travelling through dublin airport

Post by madmart132 » Mon Oct 11, 2010 2:34 am

Hi hoping somebody can help me , I am a dual nationality Irish / UK passport holder . My wife is non EU , we have been living in Spain for a year now (with Schengen visa and Spanish ID card )and my wife has just given birth . We have to get a passport for our son (Irish)and then travel back to the UK , the easiest ( and cheapest ) way for us to do this via Dublin and then on to the UK . Having read through the European directive 2004/58/EC I do not think that we should have any problems ? Can anybody help me on this ?
I cannot make a decent living in Spain and have to go to the UK before the money runs out will we be ok travelling through Eire with just our marrige cert and her ID card ? Any help would be great

Ireland
In Ireland, the Directive is transposed into the European Communities (Free Movement of Persons) (No. 2) Regulations 2006[19] amended by SI 310 of 2008[20] in reaction to the Metock case[9]. One issue with the implementation is that Ireland requires a visa of non-EEA family members of EEA citizens even if they hold 5-year residence cards of another EEA member state on the basis of being a family member of an EEA citizen, in breach of Directive 2004/38/EC[21][22].

I think you probably need to get a visa for your non-eu spouse in the light of above.

What exactly are you asking?

Are you asking about the 8 hour trip from Spain (where I assume you are presently working and living) to the UK?

Or are you asking about settling in the UK?

Does your wife's citizenship normally need a visa to enter the UK or Ireland?
