Settlement Visa Help

I'm applying for a settlement visa, I have a little problem that is in 2008 I applied for him to Visit the UK I send the document, but on the form I put down that he was my cousin.
But he is not related to me, as he is my best friends brother.

What shall I write on the settlement form where it say "8.4.10 are you and your sponsor related outside marriage?" .

They might check & say that on the visit visa it say he is my cousin, also the visit visa got rejected & went to court here in the UK, the outcome was allowed he came to the UK in Jan 2010. (I'm was the sponsor)

They will almost certainly cross-check information submitted for the spouse visa with your previous visitor visa application.

What's his nationality? I asked because cousins do marry each other in countries like Pakistan. So it might not be a problem at the end of the day.

Without wanting to encourage you to lie, I think you'll have to give the same information as you gave in your original application. HRY, marrying a cousin isn't the problem...it's that he isn't actually related to her but she was previously granted a visitor visa (after appeal) on the basis that she was sponsoring him as a cousin.

Yeah Casa, thats what I thought. If he's from a country like Pakistan where cousins do marry each other. The whole thing would look like she sponsored him to the UK(previously) as a cousin which they were (on paper) and they later marry each other as the customs allows in Pakistan(dont know where he's from anyway).

The argument would then be when they actually got married? Before or after the visit visa? or I am still getting something wrong?.

Yeah! that was deception, which could become a serious issue if it comes to the ECO's discovery. Sponsoring someone(previously sponsored as cousin) now as a spouse might be hard to explain to the ECO unless they are from a country where cousins do marry each other.

Yes he is from Pakistan. we got married after he visited the UK. He was in the UK from Jan-April 2010, we got married in June.

So shall i say he is my cousin, but not sure what to write how he is related

hmm did you have to saay how you were cousins in last application? If not then you could write anything no? how would they cross check his family in Pakistan?

Giving false information in a visa application always stands the risk of causing major problems further down the line. You'll have to give the same information you gave in the first application.

If you say NO, there would be questions on your previous sponsorship as a cousin. In my opinion, you should say YES and I dont think it should be a problem as cousins are allowed to marry each other in Pakistan.

The problem is really on the previous application where you claimed to be cousins. To have a successful application, I believe you have only 2 options:

1. Maintain that he is your cousin(cousins are allowed to marry in Pakistan anyway and he could be a distant cousin.)

2. Take the risk and tell the ECO the truth as your past deception might not be a serious issue on a spouse visa. See paragraph 320(7B &7C) or here

Wait for some more advice from the senior members or the mods and I would also suggest you consult an expert solicitor for a proffessional advice.
