Further leave to reman after civil partnership/marriage

Post by webb80 » Fri Oct 29, 2010 3:53 pm

Q1-A bit confused, once/if our proposed civil partnership visa comes through, we intend to have the ceremony asap, then apply for Further Leave to remain or is it a SET visa?

Q2-I have read we can apply for this in person through Settlement Checking office or Public Enquiry Office,is this the case?
As it says that this will be much quicker than by postal application? Usually within 24 hours?

I am British partner is from USA.
Many Thanks
Vic

1. FLR(M). Settlement application (SET(M) form) to be made only when eligible (under current rules, after 2 years).
2. Postal or in-person, your choice. SCS is only for settlement application.

Bear in mind that your partner won't be able to work legally until FLR(M) has been granted...which could take up to 3 months to process as a postal application, during which time they will also be without their passport. Applications made at a PEO are generally decided on the day.

The (in-person) application may be decided upon on the same day but, if approved, the biometric residence permit (BRP / ICFN) is usually posted within a week.
