When do we apply?

My husband got his spouse visa in Jan 2009

Start date: 24/01/09
Expiry date: 24/04/11

He arrived on 28/01/09.

My question is reading the website about the set(m) form we have to complete it says that he is meant to have been in the UK for 2 year before he can apply - which is obviously fine but also it says somewhere else you should apply before the end of your permitted stay in the UK when you are nearing the completion of the 2 year qualifying period. His visa is 27 months, so should we apply 28 days before 24/04/11 or 28 days before 28/01/11 (2 years after arrival) or can we apply somewhere inbetween this dates?

Please help - I assumed it was 28 days before the expiry but now I'm starting to think differently!

The ILR application can be made no earlier than 28 days before the 2nd anniversary of the date of arrival = 31.12.10 ..... and no later than the date of expiry of the current visa = 24.04.11.
