refusal ---retention of rights on DV and primary carer

hi i applied for retention of rights of residence on the basis of breakdown of marriage on DV as well as primary carer of child of eea national.

HO has agreed that i m fulfilling all other conditions except that i couldnt present dectree of divorce.

my application has been refused on the grounds that i couldnt present decree of divorce. but actually my spouse is not acknowledging the notice of divorse inspite of my solicitors best efforts.

Also, as primary carer of child of eea national HO has said that status can be granted only if eea spouse is dead or has left uk. My spouse is still in UK.

Is it right ??? can the case be won in appeal that i m not getting divorced as my spouse is playing dirty .

plzzzzz if anybody has got answer!!!!!!!
