4year qualifying period for ILR on HSMP JR?

Post by Smithy » Wed Nov 03, 2010 12:40 am

Hi all,

I've booked an appointment at a PEO next week Tues, urgently need some advice. I've submitted SET(0) application online and paid for myself
and 2 dependents.

I've given my arrival date as 03/10/2006, this is the "date of issue" of my residence permit on HSMP, as I made an "in-country" application for HSMP converting from working holiday to HSMP.
1st arrived in the UK 28/09/2005 on working holiday.
Got HSMP approval letter in March 2006. Applied later for LtdLTR, valid from 03/10/2006. Applied for extention Tier 1 Gen Migrant 13/10/2008 - 13/10/2011.
Have I used the correct date? Does my 4 year qualifying period start from date of issue of LtdLTR? (considering I was already in the UK at time of issue)

I've read some contradicting info online so I need some guidance pls.

Thanks

Hi all,

also following on from the above, the online form has asked the following (after I'd saved, submitted then printed the form ahead of my PEO app next week):-

Which category?Category in which you are applying for
indefinite leave to remain Highly skilled migrant under HSMP JR policy
Knowledge of language and life in the UKAre you aged 18-64 Yes No
Is your partner aged 18-64 Yes No
Your partner has passed the Life in the UK test Yes No
Your partner has successfully completed an
approved ESOL with citizenship course Yes No

It is my understanding that my wife wouldn't need to do the above tests.
Am I correct?

Per UKBA website:-
How are dependants affected?
Dependant status will follow that of the principal applicant.

Pls advise urgently.
Thanks

The date 03/10/2006 is correct.
You and your partner do not need to pass LITUK test before applying for settlement, but will need to do so before naturalisation.
