New English test does applying online before 29th nov count?

Post by Tired Traveler » Tue Nov 23, 2010 1:58 pm

Hi If you apply online before the 29th Nov for a fiancee type visa and do biometrics after the 29th Nov will you avoid needing the English language test? I know that it will have to be taken within 6 months of landing in the UK if not taken now.

When switching to FLR(M) after marriage?

I think he means

Fiance visa app before 29th November = No english test requirement

Spouse visa following on from fiance visa, application after 29th November ( within 6 months of arrival in UK) = English test

After 6 months you would have to apply for FLR(27 month visa). I thought there may have been an english test at this stage if it wasn't obtained, though you are correct you don't need it before applying for FLR.

Any ideas on my original question?

You would need it for FLR(M) (24 month leave to remain).

Thanks for responses. To clarify: If an application was made online on the 28th Nov and the biometrics/document submission was say 10th Dec would that be classed as applying before 29th nov or do they consider the application date the day you go to the embassy?

The date you pay fees for a leave to enter application is the date of application.

But yes, you would have to comply with the test before applying for FLR(M) after fiance visa.

You're talking about the ESOL alternative to the Life in the UK test (KOL).
That's fine.

I've read the above but I'm still a little unclear, so sorry for repeating questions.

If my partner applies online (for unmarried partners visa) tomorrow or this weekend ie 26th-28th,and pays her fees will she have to take the English language test?

Thanks!

The date you pay fees for a leave to enter application is the date of application.
In other words if on nov 28th you pay the fees online and type in your details, then Nov 28th is the date your application is made therefore you will not have to hand in an English test, even before you are given a date in which to hand in your documents!

I hope others can verify this if I am not correct
