How do you apply for Discretionary Leave to Remain in UK? My husband is British and he wants us to stay in England and wants our child to be born herey here no matter what. I did apply for Indefinite right to remain after 2 years of living here but was rejected as I used the wrong version of the form. Now I have over stayed for 2 months and I don't want to re-apply as they might reject it on the basis that I have over stayed which would be another waste of £840. So how do I apply for Discretionary Leave to Remain in UK?

Hi,

Without an application, you are further ruining your chances, i would suggest submit your application ASAP with the CORRECT Forms and follow the guidance available from UKBA to the law and provided you have all that, you should be fine.

I Assume you are referring to applying for ILR after staying here 2 years as a spouse?

SET(M) form is for settlement application, and not for discretionary leave.
