Why not, when the applicant has been in breach of immigration rules.

Nothing, because there is no ground for appeal. What possible explanation can the person give for working more hours than legally permitted to?

you can only appeal if you think they made a wrong decision... if you agree and they are giving you facts about his over time than on what basis can you appeal!!!???
appeal rights are given to all applicants who are refused under cerain paragraph. it doesnt mean anything if you, an applicant, agrees with their reasoning.

1. I do not think that u hav much choice as if you appeal then HO will provide the evidence that u friend have worked illegally in the UK.
2. The appeal will be refused without any doubts and the applicant will have trouble getting a UK visa for a long time.
3. Do not think that HO will be easy on this case.

He was just unfortunate, I have seen alot of people that work full time while on student visa and when they applied for the post study, they filled the N.I space and their passport got stamped with 2yrs visa. He was definitely unfortunate and may be there is some other things he did not disclose because a caseworker most of the time treats what they've got on thier table without investigating into ur privacy!!

You can work full time on the student visa in vocation or off-term period. If ur friend has worked more than 20 hrs in term time HO is right to refuse his visa as he was in breach of the immgration rules.

1) UKBA do not cross check the NI number with HMRC (unless policy has changed quite recently)
2) Even if they did, how can they use it to prove how many hours somebody worked? HMRC knows how much the person was paid and how much tax was deducted, not how many hours they worked.

Check who made NI / tax contributions using that NI# and phone up the companies who paid over the tax.
Here is some info regarding HMRC & Home Office partnership agreement.

wishful thinking....
they would know student A who worked 20 hours on average earning 6,000 odd pounds a year and another student B who earned 15000 pounds. eyebrows WILL be raised...... and why do you think every employer ask you for NI number!!!!!
