Hi All,

Plz refer to my previous posts.
I was on PSW...applying for tier-2 non-shortage occupation (salary band-D)

Please donot get disappointed...its very imp u all do the RMLT and also ask ur employer to add a cover letter detailing ur importance to the company with the COS application.

This is wat my employer did for me!

• New non-shortage occupation posts with salaries above £32,000 per annum."

Does anybody know what the cut-off salary band will be for December?
Or is it gonna be again, another UKBA's adhoc tactic. (and making money out of applications which wouldn't have been made if the requirements were known!)

We are left to see...

Yes will be interesting to see if there is any improvement. I really don't hold much hope now as I am in band E which was so far from the allocation for November that it really was pointless.

From the salary ranking this month my band will be A and we will see what they come up with now.

I applied for the urgent consideration and got the following reply: :twisted:

Dear Mr xxxl

Your request for an urgent initial allocation of Certificates of
Sponsorship outside of the monthly panel has now been considered by the
Deputy Director of Sponsorship.

The outcome of your urgent treatment request has been rejected for the
reasons detailed below:

The Operations Manager post you listed as due to start until after the
Panel has met. ( I can't figure out the theme of this highly grammatical English sentence )

Please note however that your allocation request to cover your
non-shortage occupation requirements as detailed on your 'Tier 2
(General) - Request for Initial or Additional Allocation of Certificates
of Sponsorship' form has been rolled over to be considered at the next
panel meeting. If you wish to withdraw this request prior to the next
panel meeting please inform us at:

Sponsor Licensing Unit
UK Border Agency
PO Box 3468
Sheffield
S3 8WA.

There is no right of appeal against this decision but you can make
further CoS allocation requests for exceptional consideration up until
the end of the interim limit period which will be 31 March 2011. Please
see the Sponsor Guidance for further information.

I have just been in touch with the UKBA to ascertain the status of the COS (AR) application.

Due to the current adverse weather conditions, the panel did not meet on the 1 December 2010 and is meeting on Monday.

not heard anything at all, does anybody know if the meeting that was delayed was held on Monday?

it seems every month they cannot keep a date for having the panel

we got refusal from Nov panel on 18th nov and applied for urgent consideration which normally takes 24/48 hours and this time they delayed the result of urgent consideration as well due to load of urgent applications. on 28 we've been told that as my visa is still valid after the December panel meeting so they rolled it over for normal panel hearing.
Then instead of 1st of December, the panel meeting held on 6th December due to bad weather.
We got news from our solicitor that we got Cos and after lunch our system was updated on 7th December with Cos.

MY STATUS:
I am with the same company since 2008 on PSW (tier 1) so RMLT was not required.
My salary is 42k now. Which was under review after November refusal and they agreed to raise it to over come the limit and ensured they did all to keep me with them.
We used a business immigration firm for my case (charging us a lot but it's worth spending at these times)

Any more question please let me know.....!

DEAR ALL,

As of Today I came to know that my Tier 2 General application is approved and Biometric cards will arrive within next few days with the Permit

It's a great relief for me and my family here in the UK as my hard work is well recognised

thats very good news, finally some people getting the cos

we got refusal last month (november) as we were in non shortage occupation and was in band D, we resubmitted and put in a new salary of £33.5k as we made a better job offer

my employee had to leave at end of october as his visa expired, he worked for us for a year and a half, we are worried only problem now is the market test as we dont know if we are still exempt as he did not get in the november panel or not

if from what others say and its situation this month with the wages being over 32k then we hope we can get the cos also so fingers crossed everyone

everyone who has heard so far was that for urgent consideration? we just done the standard way so though we would hear back this monday which would be 5 working days from when meeting took place

if anyone has any more news please post here

My Employer applied for initial cos in August 2010 and in Nov. they come to know HO did not receive any payment for COS.Last month my employer again send out the payment to HO .....till today not hear anything.....waiting with patience...

I have a question regarding salary if the COS gets approved.
the thing is, my employer has put salary of 40k and the job is also in shortage occupation list(Comissioning Engineer) for which hourly rate is 12.56 or 13 which if you put as 40hrs per week, the yearly becomes 26,000.
So my question is, how will they chk that my employer will be paying me 40k. I mean do they chk every year from once i get T2, or do i jst have to show 12months salary when extending or do i have to show salary of all 3yrs since i got my T2??

we have been in touch with our agency and yesterday were told that our application was in on time but was not seen at the panel, no reason was given

we were told to email it to someone and it would be looked at within the hour, this then turned to the end of the day

then we phoned this morning and told that still waiting

this afternoon found out that they did not look at all the cos applications, only some as too many and ours was not urgent enough to look at so will be rolled over into januarys meeting

my case is urgent that my staff member had to exit at end of october as we submitted cos and another form at the same time as our agency had done in the past with no problems but they changed the rules that month and told us it would be november meeting

we waiting until then after leaving country to be told november meeting was delayed and got word back end of november to say not this time as the 32k cap

we put in again with 33k and then again delayed in december and then told today that was not even seen and not urgent enough its rolled over, if this was any other business other than the government then this would never happen its total shambles

has anybody else had this problem this month?

I got the email below from my HR today;

Just to let you know that we have received another rejection from the Border Agency.

We are now required to fill a further section in on the form and resubmit.

I will need your assistance to complete the details necessary as they are pertinent to the post that you undertake.

We must choose a shortage occupation code and post title/duties from a list supplied by the Border Agency.

Can you come across to Dean Clough as soon as possible and we can go through this together.

UKBA also confirmed that with regards to the re-submission of your application, this can occur at anytime, and isn’t confined to the 1st week in each month.

This is my second application. We will re-submit next week as my visa expires 31 Jan 2011.

It is great news to hear the Verdict today that the interim limit cap was unlawful. I do hope that by next week that HO will open the Sponsorship Management System pending when they have found grounds for Appeal or by April 2011.

To God be the Glory for this new development.
