Tier 1 extension 12 months salary query

Tier 1 extension 12 months salary query

Hi,
I am applying for Tier 1 extension. I guess I need to show my last 12 months salary slips. My question is that duing the last 12 months, I was not working for 1 month, so obviously I dont have any proof for that 1 month. Instead can I show the salary of the 13th month?
So if my last 12 months is Jan to Dec 2010 and I dont have a salary for Oct 2010 so instead can I show the salary of the 13th month i.e. Dec 2009?
Will home office accept this? Can you please advise.

The guidance notes clearly state that you can claim points for "earnings in a contineous 12 month period".

However this can be shorter than 12 months (I claimed earnings points using 6 months only) but it has to be a contineous period.

However if youre applying in dec. then you can use the period oct-09 to sep-10, which should work fine.

Is that the case even if in 1 month I didnt have any salary? Let it me make it more clear:
I am planning to apply for extension in Jan 2011 so I will have to show my last 12 months salary slips which would be the for months from Dec 2010 to Jan 2010 . During this period, my salary for October 2010 was zero (as I was unemployed for a month) and when I add the rest 11 months salaries I dont cross the mark required to get more points. So instead of October, I am showing them Dec 2009 salary which implies that technically I am still showing only 12 months salaries and it is within the 15 month period as well.
Do you think they wont accept it?

Also when you say "if applying in dec. then you can use the period oct-09 to sep-10"- do I not have to start from the previous month of my application?

It has to be 12 consecutive months.

I see you putting stress on consecutive. Can I ask you one more question (I know this has been asked many times..)
My Tier 1 is from Sep 2008 to Sep 2011, so it expires in Sep next year.. can I apply for renewal now or is too early?
