Travelling to UK on Travel Document??

Post by cool_zero » Sat Dec 11, 2010 4:16 pm

Hi All,

I am currently in UK working on Tier 2 (Intra-Company Transfer) Established Staff Category. I do not work for any company outside UK and get per diem. I get full salary paid in UK. As I cannot currently apply for Tier 1 (General) while I am in UK, I intend to go back to my home country i.e. India and apply for Tier 1 visa. I wanted to know the following:

(1) When I apply for Tier 1 visa while I am currently on Tier 2 (Intra-company transfer) visa can I still travel back to UK during the time my application is being processed? My passport will be with the British High Commission during that time. So can I go back to UK on 'Travel Document' as I have a valid UK visa under Tier 2 till 2013.

(2) I intend to claim points for earnings from two different countries i.e. India & UK. 8 months in India and 4 months in UK. Will it make any impact on my application for Tier 1 as I am applying for it in a very short time span. Please note that I was physically present in India and UK for those 8 & 4 months respectively.

Please if anyone could enlighten me on this issue. Apologies for the long post and thanks for all your help.

Thanks

Your current visa, is it a Biometric residence permit or a vignette affixed to your passport?

If the latter then you will not be able to enter the UK because you'll not be able to present your visa (in the passport) at the UK Immigration control. Whether Indian immigration will allow you to pass through without a visa for the destination country (UK) is another question.

I only have a vignette affixed to my passport. Can I apply for Tier 1 if I am currently in UK and under Tier 2 Intra-company transfer (Established Staff) category? I do qualify under the PBS for Tier 1 (General).

Your reply is appreciated. Thanks for all your help. Its a fantastic forum.

Thats great news for me. Thanks a million for your reply. Just one final question and I will stop bothering you. I promise. For the available funds now I understand that I only need 800 pounds in my bank account. I am aware that one can use multiple bank accounts. My question is that while I am applying within UK can I show funds from multiple bank accounts from different countries? i.e. can I show one bank account from UK and one bank account from India.

Also is there any time frame that I should have spent on Tier 2 (ICT:ES) before applying for Tier 1 (General)?

Thanks once again for all your help. This is indeed the best forum for immigration queries.
