UK Tier1 salary individual previous earnings

Hello all,

I have a question regarding previous earnings for UK tier1 visa. It states on the uk immigration website that 12 months out of 15 months previous earnings should be shown. Is this mandatory ? I am in india currently and was out of project for 5 months within the last 15 months. So can I just show previous earnings for 10 months ?

Please do reply with any information would be helpful.

Yes, you can show less than 12 months just not more.

Hi,
I am applying for Tier 1 extension. I guess I need to show my last 12 months salary slips. My question is that duing the last 12 months, I was not working for 1 month, so obviously I dont have any proof for that 1 month. Instead can I show the salary of the 13th month?
So if my last 12 months is Jan to Dec 2010 and I dont have a salary for Oct 2010 so instead can I show the salary of the 13th month i.e. Dec 2009.
Will home office accept this?

No you can't. Maximum of twelve consecutive months in a 15 month period. Dec 2010 to Sep 2010 and Nov 2010 to Dec 2010 is 12 months, but not consecutive.

Sorry didn't understand - Dec 2010 to Sep 2010 and Nov 2010 to Dec 2010 is 12 months?

Let me rephrase my question-

I am planning to apply for extension in Jan 2011 so I will have to show my last 12 months salary slips which would be the for months from Dec 2010 to Jan 2010 . During this period, my salary for October 2010 was zero (as I was unemployed for a month) and when I add the rest 11 months salaries I dont cross the mark required to get more points. So instead of October, I am showing them Dec 2009 salary which implies that technically I am still showing only 12 months salaries and it is within the 15 month period as well.
Do you think they wont accept it?

I see you putting stress on consecutive. Can I ask you one more question (I know this has been asked many times..)
My Tier 1 is from Sep 2008 to Sep 2011, so it expires in Sep next year.. can I apply for renewal now or is too early?

You can go back upto maximum of 15 months from the date of application and you have to choose any 12 month consuctive period.

E.g. If you are applying on 1st of Jan 2011 then you can choose any 12 month consuctive period from 1st of Oct 2009 to 1st of Jan 2011.

if you were unemployed in some months then you can still apply if you have enough earnings. I guess if Bill Gates decide to claim on his salary then he will be able to qualify with one day salary so no need to produce 12 pay slips!!

I can see there was some confusion here. Yes they must be consecutive be that unemployed or employed.

So for example you could claim Jan-Dec but only earn Jan & Feb, Nov & Dec, but as long as those 4 months earn you enough points you can be unemployed for March to October

if extension rules stay the same, i will only use 7 months of the normal 12 months that one usually provides. The reason for this, is this just get me enough points to extend. But mainly because of this new rule below.

'Skilled and highly skilled migrants will need to meet the salary criteria that applied when they last extended their permission to stay.'

Seems to make sense only to claim earnings that gets you just enough points to extend otherwise you may just be shooting yourself in the foot.

Or perhaps I have misinterpreted this??

For example there is no point in claiming points for £100,000 earnings and been way over the pass mark. Because then when it comes to getting ILR you will need to show £100,000 again and you never know you may have lost your job for a couple of months or had to take serious pay cut and only earning half that!

What are other peoples thoughts on this, have I interpreted this new rule in the right way to not overshoot the points needed for extensions?? as you will held to it for ILR?

This is incorrect. They refer to 'salary criteria', not the 'salary' - so the scale of points will be the same, but your salary does not have to be (as long as you pass, obviously).
