Hi there can someone please help me explain this
A new EU law was passed in April 2006 about EEA Nationals and non EEA Nationals excising 5 year treaty rights ending on or after April 2006...
My question is:
I came into the country in May 2001 (EEA Family permit)
5 year Residence card issued June 2002
Permanent Residence card issued Dec 2007 valid for 10 years
How does the new April 2006 EU Law affect application for me to apply for citizenship?

Why didn't you apply in 2008?
Anyway, you can apply tomorrow morning and it is highly recommended

Oh I know something I should have done!!
Can I just ask if your current passport is due to expire and you send your application in for Citizenship would this cause a problem?

It shouldn't be a problem. Just send your new passport and the old one containing the pr with all other documents and life in the uk and you will be fine

NO thats the problem I have not got a new passport - just the one I have when I entered the UK - I will be applying though before the passport expires in Feb 2011.
I rung Immigration and they said it was OK - but I dont know!!!

As long as the passport is valid for 6 months you don't have to worry. If not, apply for a new passport from your consulate and there will be no problem as well

No I have said I will apply in January 2011 and the passport expires in Feb 2011!!! So there will be one month validity
To get a renewal passport from SA is terrible, it takes 6 months (if you lucky)!!!! What shall I do????

However on the UKBA website it says if you can not provide your passport you can show other means of identity and I also have the letters from the HO confirmed I have gained PR and they accept that as proof you have PR. Also I have P60's covering the whole six years!
If you do not send you Passport they want to know why - then I can obvioulsy say the passport is due to expire and renewing it? Because why am I reapplying for a South African Passport when I am applying for BC???
So stressed and worried now

KC8010, don't get your knickers in an unnecessary twist! You can also apply via NCS (search online for one nearest to you) and for a small fee they check your application, that you qualify and have all the supporting docs needed.
This way you can keep your SA passport while your BC application is sent off for processing.

haha - i am a ball of nerves!!!
OK but just worried I even go to NCS and they say cant accept application as SA passport due to expire - as surely they take a copy of the passport too that has the expiry date LOL
