Post Study Work Visa to Tier 1 General Transition

Post Study Work Visa to Tier 1 General Transition

Hi Everyone,

I got Post Study Visa in January 2010 and it is valid until Jan 2012. I want to know how I can renew my visa into Tier 1 (General), I also want to apply for extension in November 2011.

Is anyone knows what will be new rules for PSW extension.

Your help/comments will be highly appreciated.

1. It is not a renewal, but an initial application for Tier 1 (General).
2. Likewise, it is not an extension of Tier 1 (PSW) but a new application for leave to remain as a Tier 1 (General) migrant.
2. Tier 1 (PSW) cannot be extended. It is granted for 2 years once in a lifetime.

Tier 1 (General) route will be closed in April 2011. If you wish to change to Tier 1 (General), you should do it before April 2011.

amoid, If you are working, then calculate your points in the calculater provided in UKBA website. If you reach your earnings and other points, better you apply as early as possible. Latest you can apply is last week of March 2011. After that there will be no Tier-1 General Visa.

Thanks all for your reply. Actually i got job in August 2010. So if i apply in march 2011 then i cant make my points. i can apply latest by August 2011 or September 2011.

One more thing i got PSW visa on old 2009-2010 immigration rules which said that after PSW i can apply for Tier 1 General.

You can not apply in August 2011. Because, There will be no Tier-1 General after April 2011, clear ?

If you reach your earnings points before April 2011, you can apply in March 2011 at the Latest. April 2011 = No more Tier-1 General.

I am also on PSW and applying in February 2011.

But if I apply in February then how I can claim my salary points. Bcuz I started my full time job in August 2010.

Amoid, are you on perminant job or contracts ?

If you need Tier-1 General, you must apply before end of March 2011. If not, forget about it at the moment.

You cant. Simple. So forget applying for T1G before April 2011.

And after that, there will be no T1G anyway. Does not matter what rules were in place when you applied for PSW. No one promised you that T1G would stay around.

I have permanent full time job now, which i started from august 2010 and i got PSW visa in January 2010.

If you do not qualify (and apply) before the scheme is closed, you'll need to search for (and apply under) an alternate immigration category, that you qualify for then, to remain in the UK after expiry of your Tier 1 (PSW) leave to enter / remain (visa).

I have to look for different alternative ways now, bcuz i cant apply before April 2011 and after that T1G is closed.

What will happens if my company sponsor for me.?

Your question is too broad/general for anyone to answer.

if your company can sponsor you than what's the problem ....go for Tier 2.

If you can't apply for Tier 1 G before April 11, then forget it.

Yes, I will try to apply under Tier 2 General. Even if i apply from PSW to Tier 2 General i can claim 30 points (this what UKBA site said).

If your company can really sponsor you, then just go for it. Some thing is better than nothing. You will be lucky if you get sponsorship from your company.

That's an interesting point, as when you get a PSW it says you should transition into T1G as soon as you are eligible.

Could be an interesting case of estoppel, maybe you could prove (to a court) that you relied on the possibility of transferring to Tier 1 G (subject to conditions) at the time of the PSW app...
