Doesn't matter if it's your dependant wife or kids

One more question on the same topic.. please help me with the information.

If my wife graduates from a UK university while on a tier-1 general migrant dependant, will she be eligible to apply for a post-study tier 1 visa later on?

My confusion is that if the post-study visa is only for people who have studied on a tier 4 student visa or anyone can apply for that?

Also, can she make this application while she is in UK or does she have to fly down to home country (India in our case) to change the visa status.

Thanks

Why would she want to? If she changes her status to PSW, then she will be ineligible to apply for ILR with you if you subsequently apply for ILR.

Keep a watch on BIA webpage for announcements regarding PSW in the next year.

Vinny,

Thank you for the response. I understand what you mean. We are just trying to understand what all she would be eligible for after graduation.

It may happen that I may leave UK after an year (when my visa expires). I dont have any plan of getting an ILR at this point. But she plans to be around in UK for sometime if possible. I am gathering information before we plan out.

As per the existing immigration laws, can someone apply for PSW without being on a study visa previously?

Thanks

If she's eligible (and the category still exists), then she has to apply from her home country.
