Not intending to travel straight to the UK after visa issue

Post by tetis100 » Wed Dec 29, 2010 8:32 am

Dears,

My Tier 1 G visa has been issued at 1.12.2010 but I cannot travel to the UK before last of March 2011. I have read it is possible to post date the visa for 3 months but I do not know how can I do this? I want post date the visa effective date to avoid problems for ILR after 5 years.

Hearing your recommendation would be appreciated.

Thanks, it is right but please consider these:

http://www.ukvisas.gov.uk/en/ecg/ecbasi ... #103848682

CB9.4 Validity of entry clearance
ECB9.5 What if applicant is not intending to travel straight away to the UK

My question is how shall I apply for post dating?

You cannot unless you have exceptional circumstances which you don't.

That applies when they are processing your visa, not after you have received it.

What date did you specify when you made the application?

I don't see a clear answer in this thread. If his entry clearance date is Jan 12 2011, does he have to enter the UK by a certain date?

I am in a similar situation. Can't leave my current job until March, but I had to apply for Tier 1 when I did or else I would not get one.

No, one does not have to enter UK by a certain date - but if you will enter after the first 28 days you will need to extend your Tier 1 visa not once but twice before you will be able to get ILR in 5 years.

Could you further elaborate or provide me a link to where I could read more about this?

Cheers,

You can enter UK at any time as long as you hold a valid VISA. What Wunder is highlighting is the unnecessary hassle of applying for an additional extension to meet the 5 years (provided it remains 5 years) settlement criteria. The earliest one can apply for settlement is 28 days prior to meeting the above criteria. The clock for 5 year qualifying period starts kicking when you enter UK for the first time. Hope it makes sense now.
Settlement wrote:Please do not send us your application more than 28 days before you become eligible to apply. If you do, we may refuse your application with no refund of the application fee (where a fee is charged). However, you must make your application before your current permission to stay in the UK expires.
