Absence in final year before Citizenship application

Post by newbie1234 » Thu Dec 30, 2010 10:13 pm

Hi All,

I have been granted ILR in early 2010 and since then have been travelling outside UK a lot on work. So i have exceeded the 90 day limit in the last 12 months before Citizenship application

I am still paid monthly salary in UK till date and I am under 450 days requirements for 5 years preceeding my application

My questions are below

1. I will be absent for almost 350 days in the last 12 months before making an application because of assignments abroad which includes holidays(30 days). Is this ok, if i can show proof of my assignment abroad?? If yes, what type of proof is needed ??

2. My absences in the first 4 years is less than 80 days in total and so (350+80 = 430) in 5 years before making the application. Does this satisfy home office residence requirements ???

3. I read in the documents that we need to demonstrate ties with UK(home, family, estate etc) if we were to ask for absence discretion. I dont own a home and my family is here with me abroad. What else is considered as investment or ties ???? Is good bank balance or investments in UK stocks considered as good ties ??

Thanks in advance

why don't you just postpone your application for couple of months? Why risk £780 for nothing?

The nature of my job demands that i travel atleast 3 to 4 months in a year. I have been paid in UK and pay all my taxes here.

Even if i wait longer it will be that i will be abroad more than 90 days in a year. Is there no allowance/consideration for people who are seconded/travel abroad as part of their job/business ??

And there will be people who have established business in UK and travel abroad to expand their business. So wanted to know seniors thoughts on this ??

Thanks

I was exactly in a similar situation.

Infact, I had the same issue for my ILR application. I applied for my naturalisation on Dec 16th, with a letter explaining the absences ( because of business reasons). I am yet to hear from Home Office.

It is clearly mentioned in the guidance notes that the absences will be considered as exceptions if they are unavoidable because of nature of work.

relief to know that this a realistic and practical scenario and other people are in the same boat. I hope the HM considers/understands this

Good Luck and please keep us posted on the result

Thanks
