Hi,
I have applied my Dependent Visa on Tier 2 ICT on July 2010.
My Wife has applied Tier 2 ICT on April 2009.

Please advise me whether I am eligible for Tier 1 General Visa and when can I apply for it.

I am currently in UK.

Sorry nishant you cant apply for Tier 1 within UK as you are having dependant visa but yes your wife can apply for Tier 1 and you can get a Tier 1 dependant visa.

If you need to apply then you have to leave UK and then apply for from your home country.

That's not an option - as Tier 1 is closed now (for applications outside UK).

yes you are correct that Tier 1 is closed outside UK so the only option which Nishant is left with to apply from within the UK but submit his wife details for Tier 1 and Nishant becomes her dependant..

Nishant can definitely not apply within the UK.

Hi,
Thanks for your replies.

I have 1 more query.

If my company apply Tier 2 Visa for me then can I apply Tier 2 Visa from UK?

If your company applies for Tier 2 visa then you can apply for Tier 1 within UK but you need to hurry up as Tier 1 (General) is closing starting April 4th, 2011.

Neither can you switch to Tier 1 (General) (245C(f)) nor can you switch to Tier 2 (General) (245ZF(e)) .. from within the UK.

Since Tier 1 (General) is closed for overseas applicants, the only option (amongst those you have suggested) is for you to make an entry clearance application from outside the UK as a Tier 2 migrant,
