Help needed. Query from Immigration officer

Post by veeraganesh » Wed Jan 12, 2011 12:12 am

I received an email from the immigration officer requesting this

"your accounts from Tidy Money are not in the required format

Please supply full profit & loss account and a balance sheet
These should be signed by yourself and your accountant

Please send to the address below within the next 7 days"

I did sent my invoices, bank statements and accountant statement matching my transactions that also specify my net and gross income as well as expenses. It looks like I am in trouble.

Your case worker seems to be bit confused.

Full accounts are not required as long as you are providing following:

1. Letter from accontant
2. Invoices
3. Bank statements

But if query has come then what is the point in discussing it. Just serve them the documents they have asked for!

Thanks for the reply. Yes the case worker is confused. The reason I cannot give balance sheet is the accountant said he needs tax returns and other details which can only be viable when filling taz returns. I did sent P&L and for balance sheet I replied saying what accountant said. If they reject me I don't mind as I wont be paying 6000£ in tax. The system is stupid

You sent an "accountant statement"? What is this? That might have confused the case worker.

Have you read the documentary requirements for previous earnings on Tier 1?

I must also say that I don't understand why he can't provide you with a balance sheet with some accruals for taxes - it would have just made your life easier, because now you just refused to provide the case worker with what they asked for.

Since I started my self employment recently like few months ago and I didn't pay any tax yet. He said those details are essential before making a balance sheet. The requirements from HMRC or any accountant says no need for balance sheet for self employment and only requires when you have limited company. Well I did provide the required documents as per home office under self employment.

1. Accountant letter cross referring the invoices with net and gross salary.

2. invoices

3. bank statements

4. HMRC UTR number

5. NI payed bill

If they reject on the basis if no balance sheet well I will save 6000£ and not going appeal.

It still doesn't explain why your accountant couldn't just give you a balance sheet as at end December 2010. The fact that you haven't paid tax yet shouldn't make a difference - a tax return is not a pre-requisite to generate a balance sheet.

Anyways, good luck with it - hopefully it sails through.

Thanks for the reply. Yes I am also not sure why he says he cannot get a balance sheet. I could go to another accountant but cannot change in the middle. Hope the case worker realises the guidelines and the tax needs to be paid. I also got a danish green card on my passport as safe side.

You can still change the accoutant. It is not going to harm your case.

Thanks. I am not aware of that. I sent him the letter yesterday. Incase of rejection on solo basis of no balance sheet then I might appeal.
