Parents on ILR, baby born in US...can she enter UK ?

Post by hardikrs » Wed Jan 19, 2011 12:04 am

Hi Everyone,

My family has ILR (myself, my wife and my son). We got ILR in July 2009 and moved out of UK in SEP 2009. We then moved to US in OCT 2010.

My daughter was born in US in Jan 2011. She will soon be getting her US passport. We are planning to move back to the UK in April 2011 (after the new born baby gets her US passport).

Since me, my wife and my son will be returning to UK within 2 years of leaving UK, we would not have any issues (please correct me if I am wrong)

In general, US citizens are allowed to enter UK without a visa (I think for a max of 3 months).

My question is about my new born daughter. Can anyone tell me if she will be allowed to enter UK without any UK visa (ILR or otherwise) ??? Would I have to apply for her ILR through the UK embassy in the US ??? What options do I have ???

Any guidance will be highly appreciated.

If you wish to resume settlement in the UK, then baby may apply for a child settlement entry clearance, subject to the maintenance and accommodation requirements.
