Hi all,

After a two months long wait, i just got my ID card in hand. :D
and there is another enquery come up to me, wish if anyone could help?

My initial work permit visa was granted on 17/04/2008, and this time I switched to tier2 under transitional arrangements. Refer to the HO site, it shows me:

If your previous permission to stay was as a work permit holder, you can apply under the transitional arrangements for permission to stay for the period of time you need to take your total stay in the United Kingdom to five years in an eligible category or for two years if this is longer (beginning on the start date given on your certificate of sponsorship).

Thus, my new leave to remain date should be end up to 17/4/2013? Am I right?

u said u got ur id card in hand. are u talking about biometric residence permit??? if yes there would be expiry date on it

Hi,

Sorry, i might not make myself clear. Yes, i have got the ID card, and is valid until 14/8/2012, the problem is that it doesn't take my total stay up to five years(work permit visa + tier2)... and it is only granted me another 1 year and 7 months which is also shorter than two years!?

do you think this is normal or a mistake?

i dont think it is a mistake, u just need to extend this after 1 yr 7 months.

when was your work permit gonna expire?

how many years have they given you visa for, from the date of your tier 2 application?

My inital work permit visa: 17/4/2008--17/1/2011 (2 years, 9 months)
the new tier2 BRP: 13/1/2011--14/8/2012 (1 year, 7 months)

2 years, 9 months + 1 year, 7 months = 4 years, 4 months < 5 years

do follow it up with ukba.... see if you can get it changed now, rather than wait 1 yr and 7 months.

i thought it was 2 years... is your job gonna finish in august 2012??

1 yr and 7month is such a random duration. doesnt make sense.

Thanks for your reply, No, i am a permanent staff and my current project will be end on 31st Jul 2012, but i will continue to work on different project afterward. I think probably my HR did not mention i am a permanent staff when she applied the COS, so HO thought my job will finish in august 2012 ...

Anyway, thank you again for your useful comments, arsenal49! I have a better understanding on how it comes now, and i will ask my HR to confirm it tomorrow.

If your employer specified a sponsorship end date somewhere in their application to UKBA, it would explain the "odd" duration of the leave granted.

sushd's suggestion could be correct. Ask the sponsor what work dates they specified on the CoS (if they don't know they should know - or they can look at the CoS online in View Certificates).

They might have specified a contract date which ties in within 30 days of the leave granted by the UKBA.

If that's not the case then the UKBA have made a mistake and you should ask for it to be rectified. But if you ask and it turns out to be your sponsor's fault you will have wasted a lot of time and effort so do check that first. It will be a big palaver for your sponsor if they have to issue you another CoS (and you might not qualify because you can only use the Transitional Arrangement once).
