Maintenance fund - Tier 1 dependent from India for new born

Maintenance fund - Tier 1 dependent from India for new born

Hi All,

I have a query regarding maintenance fund required for my baby's tier 1 dependent visa to be applied from India. I am bit confused as to whether I need to show 800+1600+1600 or 800+533+533. (for me, my wife and baby) - [Note that me and my wife is already having tier 1 general and tier 1 dependent resp.]

I came to UK in october 2009 on tier 2 - ICT and went back to India in mid january. I came back on the same visa (no changes done to visa) in starting of April 2010 (Total of around 80 days in India). Then, I got my tier 1 in September and since April 2010, I am in UK.

Now If I consider only tier 1, I need to show 800+1600+1600 as maintenance funds for tier 1 dependent visa for my baby whereas If I consider my actual date of arrival here, i.e. October 2009, I need 800+533+533 as then I am here for more than 12 months.

I am a bit confused as I am not able to find any clarification of that on UKBA site. Can anyone please help me out.

I think the safest option is to maintain £2800 + £1600 + £1600 = £6000. It sounds ridiculous, but I was in somewhat similar situation where the dependant visa was rejected.

Amit,

The only place I could find (unfortunately after rejection) was in Tier1 application form itself. However, I applied for Visa from India. Hence, my maintenance fund was £2800. Since you applied for visa from UK, it could be just £800 (same as Tier1 application).

However, I think for dependants, the amount is £1600. I am quoting following text from the pbsdependantspolicy1.pdf, downloaded from UKBA website.
"
40. If the Tier 1 Migrant is outside the United Kingdom or has been present in the United Kingdom for less than 12 months, each family member of the Tier 1 Migrant must show that he/she, the Tier 1 Migrant, or (for children) his/her other parent who is also legally present in the United Kingdom has at least £1600 to support him/her; this is in addition to any funds the Tier 1 Migrant needs to prove he/she has enough money to support himself/herself.

41. If the Tier 1 Migrant has been in the United Kingdom for 12 months or more, each family member of the Tier 1 Migrant must have £533 to support himself/herself."

your question might be still unanswered.
In your place, I would go for the safest option of £1600 per dependant.

Thanks for your reply Madhu, I will maintain 1600 for each dependent for the worst case scenario I guess.
