9 days Gap in Workpermit to qualify for ILR

Hi All,
I came in UK in on 24th May 2007 on 5 years work permit.(Business and commercial). My visa will finish on 17th Apr.2012(17th Apr.2007 to 17th Apr 2012). So I am almost sure I am 9 days short to apply for ILR.( please say someone I am wrong! :o )

Now do I need to apply for extension? or under clause 5.2 I can qualify to apply for ILR? anyone here had success story?

If I am applying under transitional arrangement for my extension do I need to score points for English Language?

apply for extension couple of day before ur visa expires.ukba is not efficient enough to decide ur application in 9 days. u wil be staying legal until u get decision, then even if they refuse to extend, u will still qualify for ILR.

if u have already proven English language skill in ur current visa then u don't need to prove once again.

But under transitional arrangement it does suggest not require English Language skill to prove? could you please explain?

Also guys,
My employer didn't have sponsorship license yet! as I am the only employee from outside EEA. how much time it take to apply?

5.2 state - Applications that fall short of the five year continuous period
In some cases, applicants may have been granted 5 years continuous leave, but will not have spent 5 years continuously in the UK before their current leave expires. Caseworkers may count the period between entry clearance being granted and the date the applicant entered the UK towards the 5 years, provided this period was not longer than 3 months.
