Residence Requirements for Dependants

Post by Leo78 » Fri Jan 28, 2011 11:34 am

Hi Friends,

I'm planning to apply for British Citizenship along with my wife and son in the first week of March 2011.
However, I 'm bit confused regarding the residence requirements for the dependant.
I know that I can qualify but I'm not sure whether my wife would be eligible.
Can you please let me know whether we can apply together with the following details of my wife being outside UK?

Left UK-----------------Entered Uk------------------No of Days Absent
-------------------------14-May-2005---------------------------------------
29-Apr-2006-----------03-Jul-2006-------------------------64
23-Feb-2007-----------24-Feb-2008-----------------------365
06-Jan-2009-----------22-Mar-2009-------------------------74
26-Jun-2010-----------04-Jul-2010----------------------------7

She had to be outside the Uk due to pregnancy & childbirth during 23-Feb-2007 and 24-Feb-2008.
We all got our ILR together.

Please let me know if you need any other information.

Thanks

When you apply for naturalization for your wife along with your application then it looks like she was away for more than 450 days in the last 5 years. As this is the case you both cannot apply together in this March. If you are eligible then you can apply for yourself by paying £780. Let us say in 5 to 6 weeks time you get naturalized after ceremony. Then your wife can apply for naturalisation as spouse of a British citizen (another £780). In this case only last 3 years of the UK residency will be considered for the number of days absence from the UK. Then only following two periods of absence come into picture:

06-Jan-2009-----------22-Mar-2009-------------------------74
26-Jun-2010-----------04-Jul-2010----------------------------7

But if you wish to save money by applying together (£1010), you got to wait until your wife also eligible to apply.

These two possibilities are the once mentioned by Vinny in his earlier post.

Thanks nax_72! I was really confused because last year my friend applied together along with his wife but he said he had mentioned only 3 years for his wife.

Also, there was some discretion regarding the absence which I was not sure and hence the confusion.
