How much time can be allowed to spend outside UK in 5 years

Dear All,
I have one query about 180 days restrictions for Tier 1 visa holders.
My visa has started from Dec 2009(Tier 1 visa). I want to go to India for 190 days.
I want to know that will it affect during extension of PR.
I am pregnant and planning for delivery in India and I plan to be there for 190 days.
Is more that 180 days restrictions exempted for pregnancy?
Please help me.

Hi Sandeepak,

I assume you meant to ask if that will affect application for ILR/PR, not extension of PR. As per guideline in the link Vinny posted, any absences exceeding the criteria may be accepted on discretionary, even that they seem to reserve the consideration for employment or business reasons. If you can help not to be away for longer than specified, you will be on the safe side. But it all depends what you think your priority is.

Dear All,
Thank you very much for reply.
My visa start date is Dec 2010 and my first entry in UK is in Jan 2010. There is one month gap between Dec and Jan. So, I want to know whether it will be counted in 180 limitation?
Another thing as I am planning my delivery in India for 190 days consecutively then what will be the consequence for ILR?
Is pregnancy not exempted from 180 days limitation?
I have to leave to India by 28th week (7 months) of my pregnancy because after that I can not go to India by flight. If 180 days restriction is there then I have to come with 10 days of delivery.

I am really thankful for suggestions.

Is it not a max of 90 days in a year and max of 225 days in 5 years?

No and No.

90 days max for any single period away, and 180 days max over the 5 years.

Dear All,
Thank you very much for everybody.
I think I have to plan to come back to UK on 89th day and immediatly I will go to India.
Please let me know about this plan.
Can I take contract from other company which have work in India (from UK)? so that I can show the business trip for some days as well as pregnancy. but I am on Statuary Maternity Pay (maternity leave and taking allowance) so whether it would be allowed or not.
