Voluntary leaving UK after receiving refusal letter

Post by AustinCann » Fri Jan 28, 2011 4:35 am

I received refusal letter on 16/09-2010 and left UK voluntarily on 9th working day 28/09/2010. On the refusal letter it is written to call local enforcement office within 10 days of receiving the letter in case if I dont wish to appeal. I think I had not called local enforcement office that I am leaving. Is it going to a problem in future applications?

Many thanks

Could you advise on processing times for PSW application from oversees.
I am applying from Pakistan. Not sure if the high comission is still in Paksitan or visas are now being processed from Abu Dhabi? and whether it might effect the processing times?

Many thanks

make sure you submit these docs that prove when you left the uk etc. along with your application and make sure to explain it in your covering letter.

cheers

I suppose covering letter could be written in part 7 of vaf9 visa application form for psw visa. Or shall I put additional paper with visa application. I have written following so for. Is it ok or do I need to cut it down or explain more?

I made leave to remain application under the category of Tier 4 student migrant following the offer from Aston university to study for Doctor of Philosophy funded by ESPRC council[1]. By the time I received the refusal letter [2] on 20/09/2009, a fresh application within UK was not possible as I did not have leave-to-remain left. I discussed the matter with Ms Jenny Clement in student support centre[3] and I was advised to leave within 28 days of receiving refusal letter. I made travel arrangements and left UK on 31/10/2009. The travel expenses were paid by my dad[3].
ESPRC funded scholarship was only available to commence research in October and timescales could not allow a new application for entry clearance from Pakistan. I therefore de-registered from Aston University so the next candidate in the stream could take the scholarship.
At the time I graduated I was also offered position in the capacity of Graduate Electrical Engineer at Airbus UK[4]. I was eligible for PSW visa then but I found PhD offer more aligned towards my career goals. Unfortunately this offer from Airbus UK in graduate programme is not valid for September 2011, I have however applied in graduate engineer programmes for year 2011 to many companies [5].
Graduate programmes could run from 12 month to 24 month. Employers usually start telephone interviews in March and by the end of March the short-listed candidates are invited to assessment centres. Amongst the requirements, the candidates must have the right to live and work in the UK.
The grant for Tier 1 PSW visa could give me the opportunity to join a graduate programme and progress my career to meet my personal aspiration and full potential.

Many thanks

This looks fairly decent covering letter...

If i was a case worker, i would want to know why did you not leave the country within 28 days of being notified of their refusal?

Also,

i am being overly critical here but hopeully that will help you tailor your covering letter to caseworker's requirement.

Case worker, dont need to know where you were offered a job or your career plan its totally irrelevant ( unless you are going somewhere with it).

try to tie your side of story from legal point of view. I.e when was your original leave was supposed to expire, when did you apply for new app, what was the outcome, when did you receive the outcome, why you were here for more than 28 days, i think your reference [3] will be very useful here.

regards

Sorry I left UK on 30/09/2010 not 30/10/2010. I graduated in July 2010.
I hope I could answer no to following two questions in vaf9 form?

Have you ever been in breach of your immigration conditions for UK?
Have you ever been deported, removed or otherwise required to leave any country including UK?

Also I changed university after 3 years to finish last year in Aston. And I am awarded degree from Aston. Just wonder if this could be a concern?

Many thanks

Your entire covering letter refers to 2009. Your dates are all over the place. I can't advise you if you are not clear on these basic facts.

These dates are correct below

Refusal letter: 20/09/2010
Date left UK : 30/09/2010
Date of graduation: 10/07/2010

Also in the letter I was advised to call local enoforcement centre if I dont wish to make an appeal. I neither made appeal not did I contact local enforcement centre. Completely slipped off my mind. Is it a problem now?

Also please advice on university change matter which I explained in previous message.
Many thanks

Just show your boarding pass. In your passport u should have a stamp that shows the date that u returned to your home country. Get a copy of that and show it as well.

My visa was refused last year and I left the UK after 7 days after I got the refusal. I have been asking to different advisers for the same thing as you and it is not any problem if u did not overstay for more than 28 days. Also, if your dad paid the ticket is fine.

Finally, let me know in trough this post if u get your visa. I will apply in 2 weeks for PSW1 again from my country
