This info you provide HIGHLIGHTS my concerns and previous posters trying to tell me otherwise should wake up and smell the coffee and be PREPARED. Prepared meaning having your app reading to go before 5th April.

An email received two months ago from someone in UKBA may not be relevant any more as they may have changed their minds in UKBA/govt several times since then. The same way this info provided above by rajaram20 may also become obsolete with the coming weeks. The best thing is to just prepare your application to apply before 5th April even if this does not get you your 5 year ILR and you never know a year down the road the rules may change again and you can do 2nd extension(after all the law suits are over).

Someone asked in an earlier post 'What can you do about rules changes?' Well there is something you can do, or should I say you should have done already. This is what I did.

I myself when there was all this talk about changing rules back mid last year 2010 , I started looking for a new job down near London and took on a new job in December. As jobs in London pay so much more than say up in the East Midlands(due to London weighting) it has pushed me up at 2 bands in the EARNINGS criteria when I recalculate my earnings(for 12 months) in July 2011. But pushes me up only 1 band if I apply 4th April before new transitional arrangements.


There is never any harm been prepared.

I don't see any scaremongering in this post.

It is good to hear other people's views on what may/ may not happen. A lot of people are not even aware of changes in April. I have got 2 yrs left on my visa but if i were extending this year I would definately want to hear the argument from all sides - then make my decision. People may not even be aware that they can apply early - if eligible!

If there are two years left on the visa, there is really no point to extend it early because the new visa will be possiblly even shorter than the current one.

I didn't mean myself :D i meant that if my visa was to expire this year, i would probably be in a panic. Mind you, people have different pressure/ panic thresholds - mine is very low :)

Late January has come and gone, I guess its going to be early February. So we only have to wait another week to understand what these transitional arrangements are going to mean.

Is there any dissatisfaction around the Home Secretary's decision to alter the scope of Tier 1 under the full limits?

A6. The only concern put forward is the need for some form of transitional arrangement for existing Tier 1 (General) migrants who will wish to apply for extensions after April 2011. We are currently considering how any transitional arrangements should be shaped and will announce our plans in the Spring.

Learning the fate of extensions is important, but I think that it is unlikely there will be any serious changes.

Much more important is what they will do with ILR rules. And there, I am much less confident about the good outcome.

I agree with you UKSWUS.

Maybe we do not need to worry about Tier 1 extension but I feel that the ILR rules will not be good. I hope I am wrong. what is the benefit if I can extend my stay for another 4-5-7 years without getting the ILR or citizchip?

Indeed, changes in ILR rules (apart from the already proposed Salary Criteria) are the ones to be seen!! It is not very clear, whether the proposed induction of Salary Criteria would start from April (as mentioned in UKBA site) or would start along with the other changes after the forthcoming Spring Consultation to overhaul Settlement rules (as informed by Mr. Damian Green). Moreover, as we have seen so far, major changes in Immigration policies are generally implemented from April, which if pursued by this government also, would mean major changes in ILR would assume effect from April 2012.
Is anyone in this forum aware of the facts when ILR rules were changed last time in April 2006 (4 to 5 years of continuous stay in UK), I mean, the way it was conducted? Was there any consultation, and most importantly, was it brought about just weeks before implementation or people were given reasonable time to know the rules and assess the impact on their career/planning?

think you might have a good point here, one delay after another with only 7 weeks left to apply before new rules kick in

seems also they are not in hurry to publish rules for transitional arrangements from 5th April
