Urg Second extension Query(HSMP-Tier1 from Apr 09 to Apr10)

Even I am in the same boat as you guys.

Got HSMP visa : Oct - 2007
Came into country: Nov - 2007
HSMP to Tier1 extension: Oct-2009


I will fall short for PR by about 45 days, so will have to go for another Tier1 extension.

So the same confusion created by the ambigious forms and statements on UK Border agency website applies for me too.

So whenever one of you guys apply for an extension please update us here. So that we'll know how to approach for the next extension

This link does include some good point for Tier 2

"Tier 2 migrants
You can count the period between the migrant being granted entry clearance and the date they entered the UK towards the five year period providing it is no longer than three months."

Above does not seems to apply to Tier 1. Immigration rule for Tier 1 245(e) and 245Z(4 Tier2) are same for Tier 1 & Tier 2 when it comes to continus period but some how their guidence discount Tier 2 visa holder but does not do the same for Tier 1.

Also we know that guidence are not part of the law (Pankina judgement).

55. An applicant can claim points
according to the level of the quali
fi cation
he/she has. Please refer to Appendix A
Table 2 and 3 and paragraphs 12-17 of the
Immigration Rules.
56. An applicant will be awarded no points
for a Bachelor’s degree if:
(a) his last grant of entry clearance was
as a Tier 1 (General) Migrant under the
rules in place between 31 March 2009
and 5 April 2010, or
(b) (i) he has had leave to remain as a
Tier 1 (General) Migrant under the rules
in place between 31 March 2009 and 5
April 2010, and
(ii) his previous entry clearance, leave
to enter or leave to remain before
that leave was not as a Highly Skilled
Migrant, as a Writer, Composer or Artist,
as a Self-employed Lawyer, or as a Tier
1 (General) Migrant.


So people had HSMP previous to first tier1 application , they can claim points for bachelor degree

Vikas, I think the Home office has splitted the applications dates into 3 sections:

section1: applications filed before 31/mar/2009
section2: applications filed between 31/mar/2009 to 5/apr/2010
section3: applications filed after 5/apr/2010

So we need to be cautious to fill the applications for extension based on individuals circumstances. In my case,

HSMP visa approved = April'2007
Arrived to UK = June 2007
Extension Tier1 = April 2009

Shortfall for PR by 61 days. I am looking into the possibility of doing an extension before the PR.

Seniors and others please update the happenings.
If the opportunity doesn't knock, build a door.
