Duration of earning Tier1 form - gap in earning

Hi,

I have a question regarding the duration of earnings in the Tier 1 Form.

There are several boxes for 'from' and 'to'.

I plan to claim earnings from Feb 2010 to Jan 2011, however in between there was a gap in Jun 2010 when I was not working and received no income.

Will my duration still be Feb2010 - Jan 2011 or Feb 2010- May2010 and then Jul 2010 to Jan 2011.

Can I claim points for a 12 month period with a gap in between

Do I have to explicitly mention about not having any earnings in one month ? Does that cause any impact ? I still meet the sal

Hi

This might be helpful. This is what the guidance says:
102. An applicant does not have to be in continuous or full-time employment during the 12 months being assessed.
103. An applicant may claim for a period of earnings of less than 12 months if they have earned sufficient funds to claim the necessary points.
My understanding is that since u were not in continuous emplyment for a consecutive 12-month period, u can claim for the months u were actually in employment (though altogether its less than 12 months, u still can claim it based on the above), once it falls within 15 months before your application.

I'm in a similar situation myself. I hope that helps.

Thanks for the reply...It definitely helps.

But does that mean that I can claim Feb 2010 - Jun 2010 and then again Aug 2010 - Jan 2011.

I am claiming for a 12 month period within 15 months but has a break in between.

Well, i think based on the guidance, u can do one of two things:

1) Claim for Feb 2010 to Jan 2011 and explain that you were not in continuous employment for the whole period (i.e. Jun 2010), which should be allowed based on the guidance note number 102.

2) Claim for the most recent continuous period of employment only (i.e. Jul 2010 to Jan 2011) though its just 7 months, this should be acceptable based on guidance note number 103, once it falls in the 15 month period before u apply and you had sufficient earnings to claim the points.

Alternatively, u also have the option to claim for just Feb 2010 to May 2010, technically, but I dont see why u'd want to do that and they may get suspicious about u claiming just 4 months, though technically its within the guidance. I would suggest u go one of the other routes above. For what its worth, I have heard from ppl who've claimed for a 9-month period and they got the visa.

Please note that i am just a regular member and in no way a professional advisor so I would suggest u get further confirmation from someone more senior. I'm just telling you how i see it and hope it clarifies things for u.

However if I only claim for the last 7 months I dont get enough points...I dont need 12 months but I need more than 7.

Hence I was planning to claim

Feb 2010 - Jan 2011 OR

Feb 2010 - Jun 2010, Aug 2010 - Jan 2011

In first case, assuming that the rule doesnt state continuous employment and hence I should be fine.

I started considering the 2nd option only when I saw there are multiple fields on the form for to and from dates and hence wondering if I can do this
